Texas Theft Laws

Theft is what is commonly referred to as a crime of moral turpitude. Crimes of moral turpitude also include things like prostitution and perjury. People with these convictions are branded as dishonest, and unreliable. Legally, it may become extremely difficult to secure a loan, or a lease, or ever testify in court if you have a crime of moral turpitude conviction.

One way we try to make these cases go away is to make restitution. Prosecutors like to see their victims made whole. Sometimes the most efficient way to a dismissal is to pay the amount in controversy. Obviously, you shouldn’t pay back money you didn’t take, but if a misunderstanding can be fixed quickly, this is an option.

What are the Penalties for Theft Crimes?

The degree of the offense, or level of misdemeanor/felony status depends on the amount in controversy, and the presence of any prior convictions. In 2015, the Texas Legislature redefined the classifications:

  • Anything less than $100 is a class C misdemeanor, a citation. That means it’s punishable by a fine only, no jail time.
  • Between $100 and $750 is a class B misdemeanor. This carries up to 6 months in jail and a $2000 fine.
  • $750 to $2500 is a class A misdemeanor. Anything over $2500 is in felony territory.

Obviously, a felony theft charge is a terrible position to be find yourself. But even a conviction on a class C theft ticket can be life changing.

  • "Highly knowledgeable with the utmost professionalism."
Greatest Criminal Defense Attorney! Highly knowledgeable with the utmost professionalism. I was charged with a DWI 2. Attorney Will worked very hard for me and got it reduced to a DWI one, no probation, no fines, just court costs. I couldn’t ask for a better attorney!
  • "Will Mitchell did an amazing job getting my case dismissed!"
Will Mitchell did an amazing job getting my case dismissed! After failed attempts with several other top attorneys in Austin Will was able to fight for me to get my life back on track. I’m very thankful for his hard work and effort to do what others could not do. If you need an attorney to fight for you and get the job done Will Mitchell is the man. Don’t waste your time with others who will only take your money and not care what happens to you or your future. Thanks, Will.

  • "I carry his card on me, because I believe in him and trust him."
After being arrested for DWI, it is easy to feel lost, scared, confused, and unsure of where to turn for help. Luckily, I was recommended the legal services of Will Mitchell. From the initial consultation until my final court appearance, Will was there for me throughout the entire process. In a very frightening time, Will was able to put me at ease and guide me through a difficult situation. Due to his expertise and dedication, he was able to lessen my charge to a much more favorable outcome. I had multiple consultations before I was directed towards Will, and they all resulted in frustration, fear, and intimidation. I, like many Austin residents, work in the Service Industry, and was not financially able to afford much more than a public defender. His services are invaluable, but reached at a reasonable, flexible rate. I carry his card on me, because I believe in him and trust him.
  • "Mitchell knows the system and how to guide you through it all."
Well what can I say that everyone else hasn’t said?! Very glad to have found Will Mitchell. Will and his staff are highly professional and will handle your case promptly and efficiently. Mitchell knows the system and how to guide you through it all. While I intend on avoiding anymore run-ins with the law in the future, I definitely would recommend his services to anyone else who might need help.

  • "I would hire him immediately. Great lawyer, five stars."
Will Mitchell was friendly, courteous, respectful, and while I always felt welcome to ask questions about my case or even chat about the weather, he never wasted either of our time. He clearly explained the convoluted issues I was facing and how we were going to resolve them, and gave me all the information I needed about the process before I hired him so I could make an informed decision about how I was spending my money. He kept my priorities in mind and worked with me on my financial constraints while being clear on what my money would buy me. But best of all I always got friendly updates on what was happening so I was up to date on my legal status. I hope to never need him again but if I ever find myself in a clusterfuck of unpaid tickets I would hire him immediately. Great lawyer, five stars.
  • "Will is a fantastic lawyer."
Will is a fantastic lawyer. He is detail-oriented, organized, responsive, knows the law well, and is very connected in Texas. His office support is top-notch as well. I would hire him again in a heartbeat, although I hope that's never needed.
