Texas Penalties for a Second DWI

Under Texas Penal Code Section 49.09(a), the offense becomes a Class A misdemeanor when the state proves one prior qualifying intoxication-related conviction. A conviction carries a minimum confinement term of 30 days. The applicable punishment range also includes up to one year of confinement and a fine of up to $4,000.

The enhancement isn’t established simply because a prior arrest appears in a record. We examine the alleged prior conviction, including its finality, legal classification, and qualification under Section 49.09. The prosecution must also prove every element of the current allegation.

Travis County Programs for Repeat DWI Charges

Travis County operates a DWI Court for eligible repeat offenders. The program combines treatment, supervision, case management, and judicial involvement. Eligibility depends on factors such as arrest history, unresolved cases, criminal record, victim involvement, and the court’s evaluation.

DWI Court isn’t the same as Travis County’s DWI pretrial diversion program. Published county information states that second-offense cases and cases involving multiple pending DWIs aren’t eligible for that specific diversion program.
