Second DWI Attorney in Austin

Trial-Tested Defense for Your Repeat DWI & Driving Privileges

A repeat DWI arrest creates two immediate concerns: an enhanced criminal charge and a separate threat to your driving privileges. At The Law Office of Will Mitchell, we address both through personalized representation led by Attorney Will Mitchell, who handles intoxication-related offenses and driver’s license issues.

Texas uses the term driving while intoxicated, or DWI, for this charge. Although you may be searching for a 2nd DUI attorney in Austin, your court and license paperwork will generally refer to DWI. Bring that paperwork to us promptly so we can identify court dates, administrative deadlines, bond conditions, and evidence requiring attention.

Call (512) 858-8611 to discuss your repeat DWI charge and the steps you can take to protect your rights and driving privileges.

Texas Penalties for a Second DWI

Under Texas Penal Code Section 49.09(a), the offense becomes a Class A misdemeanor when the state proves one prior qualifying intoxication-related conviction. A conviction carries a minimum confinement term of 30 days. The applicable punishment range also includes up to one year of confinement and a fine of up to $4,000.

The enhancement isn’t established simply because a prior arrest appears in a record. We examine the alleged prior conviction, including its finality, legal classification, and qualification under Section 49.09. The prosecution must also prove every element of the current allegation.

A third qualifying conviction can raise a separate felony issue, but that isn’t the charge addressed here. Our review of a second-offense DWI begins with the charging documents and the prior conviction the state intends to use.

Administrative License Revocation After an Arrest

Administrative license revocation is the Texas Department of Public Safety process that can suspend driving privileges after an alleged test refusal or failure. The ALR proceeding is separate from the criminal prosecution, so resolving one doesn’t automatically resolve the other.

For an applicable suspension notice, a hearing request generally must be submitted within 15 days after service. Blood-test cases can involve a later notice and a different deadline. If you miss the applicable deadline, the hearing request may be denied while the suspension process continues.

Keep these materials together for review:

  • The temporary driving permit or suspension notice provided after the arrest.
  • Any later correspondence from the Texas Department of Public Safety.
  • Bond paperwork, including any ignition interlock device condition.
  • Documents showing the arrest date and scheduled court appearance.

We handle license issues alongside the criminal case and can determine which notice, deadline, and suspension rule apply to the documents you received.

Evidence We Examine in a Repeat DWI Case

A prior conviction doesn’t prove a new offense. We investigate the current allegation on its own facts, drawing on Attorney Will Mitchell’s extensive trial experience with intoxication-related charges.

Our review can address:

  • Traffic-stop legality: Whether the officer had a lawful basis to stop or detain you.
  • Field sobriety tests: How the tests were explained, administered, recorded, and interpreted under the conditions present.
  • Officer observations: Whether video, reports, witness accounts, or medical factors support or conflict with the officer’s conclusions.
  • Breath and blood testing: How the sample was collected, handled, tested, and documented, as well as how the result relates to the time of driving.
  • Prior-conviction proof: Whether the state’s records establish a qualifying prior DWI conviction for enhancement.

We gather available evidence and seek qualified witnesses when necessary. Our strategy reflects the admissible evidence, prior record, and your objectives rather than applying the same response to every repeat charge.

We prepare each case with trial in mind while considering resolutions that don’t require trial when they serve the client’s interests.

Same-day, after-hours, and weekend appointments are available for urgent questions following an arrest.

Travis County Programs for Repeat DWI Charges

Travis County operates a DWI Court for eligible repeat offenders. The program combines treatment, supervision, case management, and judicial involvement. Eligibility depends on factors such as arrest history, unresolved cases, criminal record, victim involvement, and the court’s evaluation.

DWI Court isn’t the same as Travis County’s DWI pretrial diversion program. Published county information states that second-offense cases and cases involving multiple pending DWIs aren’t eligible for that specific diversion program. That restriction doesn’t determine the outcome of the criminal case or establish eligibility for another option.

We can explain how local court procedures and potentially relevant program requirements relate to your circumstances without promising admission, dismissal, or a particular sentence.

  • "I would highly recommend Will as he will fight for you."
Will got my DWI charge dismissed in lieu of a reduced charge of obstruction of highway passage. I did test over .08 so I chose not to go to trial but there were a few other factors with my case compelling the prosecution to lower my penalties and probation to 15mo; at which time my obstruction charge will also be dismissed. I was able to take care of all my classes, evals, and community service prior to ever seeing the judge so I think that helped my case. Will and Olivia were eager to help me understand what was happening and answered all my calls and emails very promptly. I would highly recommend Will as he will fight for you.
